Water and the Law: what rights does SA have to water upstream?

The seminar entitled "Water and the Law" assesses both the genesis and development of water law in Australia in order to provide an explanation of how we have arrived at this current water crisis. In the Advertiser the South Australian Minister for the River Murray and Water Security said, the State Governmnet will not take the New South Wales Government to the High Court to contest rights to the flood waters as any submission would fail. Mike Young comments on floodwater damming
"University of Adelaide Environment Institute executive director Mike Young said existing regulations allowed NSW to fill dams and flood wetlands before water reached Menindee. "Investing in infrastructure means NSW and Victoria have a much greater capacity to run the system so that SA gets its absolute minimum," Professor Young said. "The original spirit of the agreement was that the minimum was going to be the worst case (scenario). "The minimum is now the norm." "
